\u00dcberraschung: SMS von o2 dar\u00fcber, dass\u00a0mein Prepaid-Guthaben bald verfallen wird, wenn ich nicht neu einzahle. Und das gleich zwei mal gegen 5 Uhr morgens:<\/p>\n

Gut, jetzt ist morgens Ruhe. Ich habe meine Prepaid-Karte aufgeladen.<\/p>\n

Aber wie steht’s mit der f\u00fcrsorglichen Warnung von o2? Verf\u00e4llt mein Guthaben, wenn ich mein Guthabenkonto nicht alle 6 Monate\u00a0wieder auflade?<\/p>\n

<\/p>\n

Geben uns die AGBs<\/a>\u00a0von o2 eine Antwort? Vielleicht in Ziffer 6.3:<\/p>\n

Der Kunde kann das gesamte auf dem Guthabenkonto befindliche Guthaben f\u00fcr einen Zeitraum von jeweils 6 Monaten ab \u00dcbertragung verbrauchen. Mit jeder neuen \u00dcbertragung von Guthaben auf das Guthabenkonto wird der 6-Monats-Zeitraum f\u00fcr das gesamte auf dem Guthabenkonto befindliche Guthaben neu gestartet. Im \u00dcbrigen gilt Ziffer 6.5.<\/p><\/blockquote>\n

Die Wirksamkeit von AGB-Klauseln setzt u.a. voraus, dass diese „klar und verst\u00e4ndlich“ (\u00a7 307 I 2 BGB)\u00a0sind. Ich musste die Klausel mehrfach lesen, um zu erahnen, was o2 damit hinsichtlich des Guthabenverfalls gemeint haben k\u00f6nnte. Vielleicht verst\u00f6\u00dft die Klausel damit schon gegen das Transparenzgebot.<\/p>\n

H\u00e4lt man die Klausel aber f\u00fcr verst\u00e4ndlich, ist die Klauselkontrolle anhand der kundenfeindlichsten Auslegung durchzuf\u00fchren. Auch das w\u00e4re kritisch f\u00fcr o2 … .<\/p>\n

Aber jetzt weiter im Hilfsgutachten. Da k\u00f6nnte man die Lesart unterstellen, dass das Guthaben nach dieser AGB-Klausel nicht verfallen soll. Aber warum erinnert\u00a0o2 die Kunden dann in den SMS an einen drohenden Verfall?\u00a0Doch wohl, um diese\u00a0zur Einzahlung auf das Guthabenkonto zu veranlassen. Wenn man nun annimmt, dass das Inaussichtstellen eines in Wirklichkeit nicht drohenden \u00dcbels eine T\u00e4uschung darstellt, k\u00f6nnte man juristisch auf allerlei Gedanken kommen … . Aber warten wir mal ab, was o2 dazu sagt – die Anfrage ist unterwegs :-).<\/p>\n

In meinem Fall habe ich mich daf\u00fcr entschieden, mein Guthabenkonto wieder aufzuladen, denn nach Ziffer 6.5 der AGBs kann ich mir mein Guthaben immerhin auf schriftlichen Antrag bei Beendigung des Vertrages auszahlen lassen:<\/p>\n

Ein bei Beendigung des Vertrages positiver Saldo auf dem Guthabenkonto wird auf schriftlichen Antrag des Kunden auf ein von ihm zu benennendes Bankkonto ausgezahlt.<\/p><\/blockquote>\n

Bei der Gelegenheit noch ein Blick auf eine Fall-Alternative, die das fr\u00fchere\u00a0Klauselwerk von o2 betraf. Dort hie\u00df es seinerzeit:<\/p>\n

Ein Guthaben, dessen \u00dcbertragung auf das Guthabenkonto mehr als 365 Tage zur\u00fcckliegt, verf\u00e4llt, sofern es nicht durch eine weitere Aufladung, die binnen eines Monats nach Ablauf der 365 Tage erfolgen muss, wieder nutzbar gemacht wird.<\/p><\/blockquote>\n

Diese Klausel hat das OLG M\u00fcnchen f\u00fcr unwirksam erkl\u00e4rt:<\/p>\n

Zu Recht ist das Landgericht zu dem Ergebnis gelangt, dass die in den Allgemeinen Gesch\u00e4ftsbedingungen der Beklagten enthaltene Klausel a) (\u201eEin Guthaben, dessen \u00dcbertragung auf das Guthabenkonto mehr als 365 Tage zur\u00fcckliegt, verf\u00e4llt, sofern es nicht durch eine weitere Aufladung, die binnen eines Monats nach Ablauf der 365 Tage erfolgen muss, wieder nutzbar gemacht wird.\u201c) gem\u00e4\u00df \u00a7 307 Abs. 1 i.V.m. Abs. 2 Nr. 1 BGB unwirksam ist.<\/p><\/blockquote>\n

(OLG M\u00fcnchen, Urt v. vom\u00a022.06.2006, 29 U 2294\/06, Rn. 52)<\/p>\n

Also h\u00e4tte eine solche Verfallklausel in AGBs auch nicht wirksam vereinbart werden k\u00f6nnen. Das k\u00f6nnte schon ein Klausur-Thema sein.<\/p>\n

Update<\/span><\/strong> (21.01.2016):<\/p>\n

Inzwischen hat das Kundenmanagement von o2 auf meine Anfrage geantwortet:<\/p>\n

Das Oberlandesgericht M\u00fcnchen hat dar\u00fcber befunden, dass das Guthaben von Prepaidkarten k\u00fcnftig nicht mehr gel\u00f6scht werden darf. Selbstverst\u00e4ndlich wird o2 sich nach diesem Urteil richten.<\/p>\n

Die Nutzungsdauer von sechs\/zw\u00f6lf Monate gilt jedoch weiterhin. Erfolgt nach Ablauf dieses Verbrauchszeitraumes keine Aufladung, endet die Prepaid-Vertragslaufzeit und die Mobilfunknummer wird im Netz von o2 Germany abgeschaltet. In diesem Fall haben unsere Kunden die M\u00f6glichkeit, sich vorhandenes Restguthaben gem\u00e4\u00df dem Urteil des OLG M\u00fcnchen auszahlen zu lassen.<\/p>\n

M\u00f6chten die Kunden Ihre Prepaid-Card auch weiterhin nutzen und ihre gewohnte Rufnummer beibehalten, ist es nach wie vor notwendig, dass sie Guthaben nachladen. In diesem Fall steht das Restguthaben wieder zur Verf\u00fcgung. Per Bank\u00fcberweisung k\u00f6nnen Kunden schon ab 0,01 \u20ac
\nIhr Prepaid-Konto aufladen.<\/p><\/blockquote>\n
