Der Erkl\u00e4rungsempf\u00e4nger ist bspw. zur Verweigerung berechtigt, wenn er Strafporto<\/span> zahlen oder sich beleidigenden \u00c4u\u00dferungen aussetzen m\u00fcsste.<\/a><\/sup><\/p><\/blockquote>\n

In der Sache ist die Feststellung sicher richtig. Doch ist „Strafporto“ die korrekte\u00a0Terminologie?<\/p>\n

<\/p>\n

In der Brosch\u00fcre „Leistungen und Preise<\/a>“ der Deutschen Post vom 01.01.2016 hei\u00dft es auf Seite 31:<\/p>\n

Einziehungsentgelt<\/p>\n

Ist eine Sendung nicht oder nicht vollst\u00e4ndig frankiert, kann die Deutsche\u00a0Post die Annahme verweigern oder die Sendung zur\u00fcckgeben bzw. zur Abholung\u00a0bereithalten oder ohne Benachrichtigung des Absenders bef\u00f6rdern.
\nDaf\u00fcr wird ein Nachentgelt berechnet (= fehlendes Porto + Einziehungsentgelt).\u00a0Der Empf\u00e4nger kann das Nachentgelt f\u00fcr den Absender bezahlen,\u00a0ansonsten bleibt der Absender zur Zahlung verpflichtet.<\/p><\/blockquote>\n

Die Frage, ob es „Strafporto“ oder „Nachentgelt“ hei\u00dft, ist jedoch f\u00fcr Klausurenersteller relevanter als f\u00fcr Klausurenbearbeiter.\u00a0Fleck\/Arnold bspw. schreiben in der JuS 2009, 426 (427):<\/p>\n

Die Sekret\u00e4rin des I vergisst in der Hektik, den Brief zu frankieren, und gibt ihn unfrei zur Post. Der Postbote erreicht den F tats\u00e4chlich am Freitag und will ihm \u2013 gegen die Zahlung eines Strafportos von 3,30 Euro \u2013 den Brief aush\u00e4ndigen. F, der nicht bereit ist, Strafporto zu bezahlen, verweigert die Annahme. Mit dem Vermerk \u201eAnnahme verweigert\u201d trifft der Brief am Samstag unge\u00f6ffnet wieder bei I ein.<\/p><\/blockquote>\n

\"Nachentgelt\"<\/a><\/p>\n

Wer nun diese Klausur l\u00f6st, der sollte den Sachverhalt so hinnehmen, wie er ist, und in der L\u00f6sung somit davon ausgehen, dass der Postbote „Strafporto“ verlangt. Wenn jedoch im Sachverhalt die Nachzahlung nur untechnisch beschrieben wird, dann sollte man als Klausurant den technischen Begriff verwenden, und der hei\u00dft „Nachentgelt“.<\/p>\n

P.S. Aus Sicht der Post sollte die Bezeichnung „Strafporto“ vermieden werden, da ein Strafelement fehlt:<\/p>\n

Das Nachentgelt setzt sich aus dem fehlenden Porto und dem Einziehungsentgelt zusammen. Dieses ist keineswegs als „Strafporto“ anzusehen. Vielmehr deckt es einen Teil unseres zus\u00e4tzlichen Bearbeitungsaufwands ab.<\/p><\/blockquote>\n

Fr\u00fcher gab es die Bezeichnung „Nachgeb\u00fchr“. Diese musste aber im Zuge der Privatisierung der Post in „Nachentgelt“ ge\u00e4ndert werden:<\/p>\n
