In dem etwas turbulenten Geschehen rund um die Partnervermittlung &#8222;Amore Grande&#8220; tauchte mehrfach ein rechtshistorisches Fossil auf: Die Kuppelei als Straftatbestand.<\/p>\n<p>Seinen Anfang nahm das bei Minute 8:25 in einem Dialog zwischen Wenke junior (dem Mitbetreiber und Programmierer von &#8222;Amore Grande&#8220;) und dem Kommissar Simmel:<\/p>\n<blockquote>\n<div>Wenke junior: Das ist h\u00f6here Mathematik.<\/div>\n<div>Kommissar Simmel: Eher h\u00f6here Kuppelei, ne.<\/div>\n<div>Wenke junior: Eine Dienstleistung. Ein dynamisch lernendes System. Unser Kunde muss mitmachen, bewerten, gut oder schlecht, und das Profil passt sich an, die Vorschl\u00e4ge werden besser.&nbsp;<\/div>\n<\/blockquote>\n<div>Na gut, dachte man, eine eher beil\u00e4ufig saloppe Bemerkung, nichts weiter juristisch Ernstes.<\/div>\n<div><!--more--><\/div>\n<div>Aber sp\u00e4testens ab Minute&nbsp;12:14 lie\u00df sich diese Hypothese nicht mehr aufrechterhalten, wie folgender Dialog beweist:<\/div>\n<div>&nbsp;<\/div>\n<blockquote>\n<div>Wenke junior: Es gibt wenige Gewinner und harte K\u00e4mpfer in diesem Gewerbe.&nbsp;<\/div>\n<div>Kommissar Simmel: Gewerbe, was denn, ich mein, Kuppelei ist immer noch\u00b4n Straftatbestand, wenn man\u00b4s genau nimmt, \u00a7 180a StGB, oh und Gewinnmaximierung als ein Motiv, drei Jahre Haft, zack, bumm, bonjour.<\/div>\n<div>(Kommissarin Marie Brand blickt ihn kritisch an)&nbsp;<\/div>\n<div>Ja was denn, ich mein&#8216; ja nur.<\/div>\n<\/blockquote>\n<div>\n<p>Da sollte man doch meinen, die Drehbuchverfasser h\u00e4tten das Strafgesetzbuch konsultiert. Da findet man aber unter \u00a7 180a StGB nur &#8222;Ausbeutung von Prostituierten&#8220;:<\/p>\n<div>\n<blockquote>\n<div>(1) Wer gewerbsm\u00e4\u00dfig einen Betrieb unterh\u00e4lt oder leitet, in dem Personen der Prostitution nachgehen und in dem diese in pers\u00f6nlicher oder wirtschaftlicher Abh\u00e4ngigkeit gehalten werden, wird mit Freiheitsstrafe bis zu drei Jahren oder mit Geldstrafe bestraft.<\/div>\n<div>&nbsp;<\/div>\n<div>[&#8230;]<\/div>\n<\/blockquote>\n<div>Irgendwie haben sich die Drehbuch-Verfasser dann in dieses Leitmotiv verliebt, denn es geht mit dem Thema &#8222;Kuppelei&#8220; weiter.<\/div>\n<div>&nbsp;<\/div>\n<div>1:02:33:<\/div>\n<\/div>\n<\/div>\n<blockquote>\n<div>Kommissar Simmel: \u00c4h, Frau Brand, \u00e4h, Verkuppeln is\u00b4ne Straftat.<\/div>\n<div>Kommissarin Marie Brand: Hm, hm.<\/div>\n<div>Kommissar Simmel: Also, wenn man\u00b4s genau nimmt.<\/div>\n<\/blockquote>\n<div>&nbsp;<\/div>\n<div>1:27:11:<\/div>\n<blockquote>\n<div>Kommissarin Marie Brand: Vielleicht gehen Sie danach nochmal in dieses nette kleine Restaurant.<\/div>\n<div>Kommissar Simmel: \u00a7 180a StGB, Frau Brand, Kuppelei.<\/div>\n<div>Zeugin Meinert: Kuppelei? (lacht) Sie sind echt witzig.<\/div>\n<\/blockquote>\n<div>Um das Ganze zu retten, k\u00f6nnte man zu Gunsten der Drehbuch-Verfasser annehmen, dass sie einfach einen Jux machen wollten (&#8222;Sie sind echt witzig&#8220;), was zu den humoristischen T\u00f6nen in dem Krimi passen w\u00fcrde. Aber dazu passt nicht der Verweis auf \u00a7 180a StGB.<\/div>\n<div>&nbsp;<\/div>\n<div>Jedenfalls gibt die Anspielung auf den Straftatbestand der Kuppelei Anlass, der Frage nachzugehen, welchen Inhalt dieser Straftatbestand hatte, der&nbsp;schon l\u00e4ngst abgeschafft wurde, nachdem aber im rechtshistorischen Teil von Pr\u00fcfungen durchaus noch gefragt werden k\u00f6nnte.<\/div>\n<div>&nbsp;<\/div>\n<div>Die letzte Fassung von \u00a7 180 StGB lautete:<\/div>\n<div>\n<div>\n<blockquote>\n<div>(1) Wer gewohnheitsm\u00e4\u00dfig oder aus Eigennutz durch seine Vermittelung oder durch Gew\u00e4hrung oder Verschaffung von Gelegenheit der Unzucht Vorschub leistet, wird wegen Kuppelei mit Freiheitsstrafe von einem Monate bis zu f\u00fcnf Jahren bestraft; auch kann zugleich auf Geldstrafe von einhundertf\u00fcnfzig bis zu sechstausend Mark sowie auf Zul\u00e4ssigkeit von Polizei-Aufsicht erkannt werden.<\/div>\n<div>&nbsp;<\/div>\n<div>[&#8230;]<\/div>\n<\/blockquote>\n<\/div>\n<\/div>\n<div>Mit dem Vierten Gesetz zur Reform des Strafrechts (BGBl I 1973, 1725, 1728) erhielt dann \u00a7 180 StGB einen neuen Inhalt, n\u00e4mlich &#8222;F\u00f6rderung sexueller Handlungen Minderj\u00e4hriger&#8220;.<\/div>\n<div>&nbsp;<\/div>\n<div>Fazit: Kuppelei ist Rechtsgeschichte &#8211; aber nicht beim ZDF.<\/div>\n<div>&nbsp;<\/div>\n<div>P.S.
