Heute kommen wir zum dritten Beitrag in unserer Serie zum LTO-Erbrecht-Quiz.<\/p>\n

Passt die Antwort zur Frage nach den „besonderen Voraussetzungen“?<\/p>\n

<\/p>\n

Wahrscheinlich nicht. Denn die Fragestellung \u201eWelcher dieser Vorg\u00e4nge unterliegt keinen besonderen Voraussetzungen\u201c ist leicht missverst\u00e4ndlich. Denn nat\u00fcrlich unterliegen alle diese \u201eVorg\u00e4nge\u201c (auch das kein so besonders spezifischer juristischer Oberbegriff) jeweils ihren eigenen \u201eVoraussetzungen\u201c.<\/p>\n

Aus der f\u00fcr richtig erkl\u00e4rten Antwort kann man entnehmen, dass eigentlich Voraussetzungen der Form gemeint sind. Aber auch die werden nicht genau genug erl\u00e4utert, wie eine Betrachtung der zitierten Normen ergibt:<\/p>\n

\u00a7 2253 Widerruf eines Testaments<\/p>\n

Der Erblasser kann ein Testament sowie eine einzelne in einem Testament enthaltene Verf\u00fcgung jederzeit widerrufen.<\/p><\/blockquote>\n

Da fehlt das Wort \u201eformfrei\u201c, das in der L\u00f6sungsantwort auftaucht.<\/p>\n

\u00a7 2254 Widerruf durch Testament<\/p>\n

Der Widerruf erfolgt durch Testament.<\/p><\/blockquote>\n

Ist der Wortlaut von \u00a7 2254 in dem Sinne \u201eirref\u00fchrend\u201c, dass der Widerruf \u2013 entgegen dem Wortlaut von \u00a7 2254 BGB – \u201enicht zwingend durch ein neues Testament geschehen\u201c muss?<\/p>\n

Nein, das ist komplizierter:<\/p>\n

Diese Bestimmung [sc. \u00a7 2254 BGB, M.H.] stellt klar, dass der Widerruf eines Testaments selbst Testament ist, also der gleichen Form bedarf wie ein Testament, allerdings nicht derselben wie das zu widerrufende Testament.<\/p><\/blockquote>\n

(BeckOK BGB\/Litzenburger 2017 \u00a7 2254 Rn. 1)<\/p>\n

Das Widerrufstestament ist selbst Verf\u00fcgung von Todes wegen und muss daher ohne jede Einschr\u00e4nkung allen gesetzlichen Anforderungen an die f\u00fcr den Widerruf gew\u00e4hlte Testamentsform entsprechen.<\/p><\/blockquote>\n

Allerdings ist richtig, dass ein Testament auch durch Vernichtung der Testamentsurkunde widerrufen werden kann (\u00a7 2255 BGB). Wahrscheinlich ist das mit der Formulierung gemeint, dass der Widerruf \u201enicht zwingend durch ein neues Testament geschehen\u201c m\u00fcsse.<\/p>\n
