\"\"<\/a>Heute ist der dritte Geburtstag des Blogs. Da lehne ich mich zun\u00e4chst einmal entspannt zur\u00fcck und denke: Aller guten Dinge sind drei.<\/p>\n

Doch in dem Sprichwort geht es gar nicht um drei \u201eDinge\u201c, auch wenn Reinhard Mey<\/a> das sch\u00f6n humorvoll so singt.<\/p>\n

Aber was bedeutet nun: \u201eAller guten Dinge sind drei\u201c?<\/p>\n

Dreimal darfst Du raten.<\/p>\n

<\/p>\n

\u201eDing\u201c ist eine Abwandlung von \u201eThing<\/a>\u201c, der Bezeichnung f\u00fcr eine germanische Gerichtsversammlung. Und das \u201eAller guten Thinge sind drei\u201c spielt auf den Rhythmus der regul\u00e4r dreimal im Jahr abgehaltenen Gerichtstage an.<\/p>\n

Gibt es einen Bezug auf die Drei auch heute noch als Argumentationsmuster im Recht?<\/p>\n

Dazu folgender Fall:<\/p>\n

In einer komplexen sozialrechtlichen Situation ging es u.a. um die Frage, wie viele Meldeaufforderungen in einem bestimmten Zeitraum an eine Bezieherin von Leistungen zur Sicherung des Lebensunterhaltes nach dem SGB II gerichtet werden d\u00fcrfen. Zu dieser Frage hatte das Bundessozialgericht ausgef\u00fchrt:<\/p>\n

Die Abfolge von siebenmal derselben Meldeaufforderung mit denselben Zwecken in nahezu w\u00f6chentlichem Abstand an die Kl\u00e4gerin verst\u00f6\u00dft jedoch gegen die vor einer Meldeaufforderung notwendige Ermessensaus\u00fcbung wegen einer Ermessensunterschreitung, weil relevante Ermessensgesichtspunkte nicht ber\u00fccksichtigt worden sind \u2026 . Zumindest nach der dritten gleichlautenden Meldeaufforderung mit dem Ergebnis der Nichtwahrnehmung des Termins h\u00e4tte der Beklagte nicht in der bisherigen Weise fortfahren d\u00fcrfen.<\/p><\/blockquote>\n

Da ist sie wieder, die Drei. Das Sozialgericht Trier hat daran in deutlicher Weise Ansto\u00df genommen:<\/p>\n

Diese – offensichtlich „aus dem Bauch heraus“ gegriffene – Begrenzung auf lediglich „drei“ („aller guten Dinge sind drei“?) zul\u00e4ssige, gleichartige Meldeaufforderungen ist schlicht dem Gesetz nicht mehr zu entnehmen und w\u00e4re im konkreten Fall dieses Meldevers\u00e4umnisses naturgem\u00e4\u00df noch nicht erreicht, weshalb auch unter Zugrundelegung dieser Ma\u00dfst\u00e4be „insgesamt“ oder „grunds\u00e4tzlich“ keine fehlerhafte Rechtsanwendung festgestellt werden kann.<\/p><\/blockquote>\n

P.S. Irgendwie kommt man an der Drei nicht vorbei, selbst wenn sie nicht Teil des Plans ist. So auch hier im Blog:<\/p>\n
