Hat das mit der Subsidiarit\u00e4t so seine Richtigkeit?<\/p>\n

<\/p>\n

Bei der Suche nach einer L\u00f6sung steigen wir mit LTO in die EU-ErbVO (Verordnung (EU) Nr. 650\/2012 des Europ\u00e4ischen Parlaments und des Rates vom 4. Juli 2012 \u00fcber die Zust\u00e4ndigkeit, das anzuwendende Recht, die Anerkennung und Vollstreckung von Entscheidungen und die Annahme und Vollstreckung \u00f6ffentlicher Urkunden in Erbsachen sowie zur Einf\u00fchrung eines Europ\u00e4ischen Nachlasszeugnisses) ein. Auf diese nimmt Art 25 EGBGB Bezug:<\/p>\n

Soweit die Rechtsnachfolge von Todes wegen nicht in den Anwendungsbereich der Verordnung (EU) Nr. 650\/2012 f\u00e4llt, gelten die Vorschriften des Kapitels III dieser Verordnung entsprechend.<\/p><\/blockquote>\n

Geregelt ist hier also der Fall, dass eine Rechtsnachfolge von Todes wegen nicht <\/strong>in den Anwendungsbereich der Verordnung f\u00e4llt. F\u00fcr diesen Fall wird aber nicht die subsidi\u00e4re Geltung des EGBGB angeordnet, sondern stattdessen eine entsprechende Anwendung der Vorschriften des Kapitels III dieser Verordnung. Daraus zieht Rauscher folgenden Schluss:<\/p>\n

Das internationale Erbrecht ist de facto vollst\u00e4ndig europ\u00e4isiert, weil Art. 25 Abs. 1 EGBGB subsidi\u00e4r auf die EU-ErbVO verweist.<\/p><\/blockquote>\n

Man hat es also im Ergebnis mit einer subsidi\u00e4ren Verweisung auf die EU-ErbVO zu tun.<\/p>\n
