Eine davon ist im \u00f6ffentlichen Recht der Pr\u00fcfungsma\u00dfstab des Bundesverfassungsgerichts bei einer Urteilsverfassungsbeschwerde.<\/p>\n<p>Dazu schreibt Altevers in der R\u00dc 11\/14, 724 (727):<\/p>\n<blockquote><p>Da das BVerfG kein Superrevisionsgericht ist, pr\u00fcft es nicht die richtige Anwendung des einfachen Rechts, sondern lediglich das Vorliegen einer spezifischen Verfassungsverletzung. Eine solche ist anzunehmen, wenn das Gericht gar nicht erkannt hat, dass es im grundrechtsrelevanten Bereich agiert oder wenn die angegriffenen Entscheidungen auf einer grunds\u00e4tzlich unrichtigen Anschauung von Bedeutung und Tragweite eines Grundrechts, insbesondere vom Umfang des Schutzbereichs, beruhen (sog. Heck&#8217;sche Formel).<\/p><\/blockquote>\n<p>Sollte man das in einer Klausur so behandeln? Ich w\u00fcrde &#8222;nein&#8220; sagen.<\/p>\n<p><!--more--><\/p>\n<p>Die Heck&#8217;sche Formel (die nach dem Berichterstatter in diesem Verfahren, Karl Heck, benannt wurde) lautet vollst\u00e4ndig (BVerfG, <a title=\"1 BvR 144\/06\" href=\"https:\/\/www.bundesverfassungsgericht.de\/entscheidungen\/rk20060222_1bvr014406.html\" target=\"_blank\">1 BvR 144\/06<\/a> vom 22.2.2006, Absatz-Nr. 10):<\/p>\n<blockquote><p>Die normalen Subsumtionsvorg\u00e4nge innerhalb des einfachen Rechts sind so lange der Nachpr\u00fcfung des Bundesverfassungsgerichts entzogen, als nicht Auslegungsfehler sichtbar werden, die auf einer grunds\u00e4tzlich unrichtigen Anschauung von der Bedeutung eines Grundrechts, insbesondere vom Umfang seines Schutzbereichs beruhen und auch in ihrer materiellen Bedeutung f\u00fcr den konkreten Rechtsfall von einigem Gewicht sind.<\/p><\/blockquote>\n<p>Wir sehen also, dass Altevers in der R\u00dc den zweiten Halbsatz der Heck&#8217;schen Formel hat wegfallen lassen.<\/p>\n<p>Zudem gibt es eine weitere Abgrenzungsformel, die herangezogen werden kann: Die sog.\u00a0Schumann\u2019sche Formel.
