Das ist mir zuerst gar nicht aufgefallen, denn ich habe dort die wunderbare Musikvorf\u00fchrung eines reisenden Stra\u00dfenmusikanten genossen. Erst sp\u00e4ter erinnerte ich mich beim Betrachten des Fotos – das ich seinerzeit aufgenommen hatte – daran, was uns in der Polizeirechtsvorlesung im Studium zum Zweckveranlasser gesagt worden war. Aber nun der Reihe nach.<\/p>\n\n\n\n\n\n\n\n
Als Klassiker zum Zweckveranlasser wurde uns die Entscheidung des preu\u00dfischen OVGE von 1901 vorgestellt. Darin ging es um einen Einzelh\u00e4ndler, der in seinem Schaufenster etwas Spannendes bot, mit der Folge, dass das Trottoir durch neugierige stehenbleibende Passanten blockiert wurde. In unserer Vorlesung wurde seinerzeit die Fallkonstellation moderat modernisiert: In einem Schaufenster posierten Models und l\u00f6sten den gleichen Effekt (Zusammenballung von Zuschauern auf dem Gehsteig) aus. Rekapitulieren wir kurz, was unter einem Zweckveranlasser zu verstehen ist: <\/p>\n\n\n\n

Und siehe da: Einem solchen Zweckveranlasser bin ich nun tats\u00e4chlich in M\u00fcnchen begegnet. Der Stra\u00dfenmusikant hat eine an sich neutrale Handlung vorgenommen. Seine Musik hat sicherlich per se keine Gefahrenschwelle \u00fcberschritten. Da seine Musik aber bei den Passanten so gut ankam, sind diese auf der Stra\u00dfe stehen geblieben und dadurch entstand eine Gefahr f\u00fcr die \u00f6ffentliche Sicherheit. Damit will ich nun gewiss nicht sagen, dass Anlass f\u00fcr ein obrigkeitliches Eingreifen bestanden h\u00e4tte.
