{"id":1010,"date":"2016-02-15T10:00:33","date_gmt":"2016-02-15T09:00:33","guid":{"rendered":"http:\/\/bloghosting.jurmatix.de\/klartext-jura\/?p=1010"},"modified":"2016-02-12T18:00:37","modified_gmt":"2016-02-12T17:00:37","slug":"schmerzensgeld-funktionen","status":"publish","type":"post","link":"https:\/\/bloghosting.jurmatix.de\/klartext-jura\/2016\/02\/15\/schmerzensgeld-funktionen\/","title":{"rendered":"Schmerzensgeld &#8211; Funktionen"},"content":{"rendered":"<p>In dem Buch &#8222;Basiswissen Jura f\u00fcr die m\u00fcndlichen Pr\u00fcfungen&#8220; von P\u00f6tters\/Werkmeister, 2014, lesen wir auf Seite 61:<\/p>\n<blockquote><p>Welchen Funktionen dient das Schmerzensgeld?<\/p><\/blockquote>\n<p>Dann folgt die Muster-Antwort:<\/p>\n<blockquote><p>Nach dem BGH soll das Schmerzensgeld i.S.d. \u00a7 253 Abs. 2 BGB dem Gesch\u00e4digten einen angemessenen Ausgleich f\u00fcr diejenigen Sch\u00e4den bieten, die nicht verm\u00f6gensrechtlicher Art sind, und zugleich dem Gedanken Rechnung tragen, dass der Sch\u00e4diger dem Gesch\u00e4digten Genugtuung schuldet f\u00fcr das, was er ihm angetan hat.<\/p><\/blockquote>\n<p>Dies wird dann im Schluss-Satz wie folgt zusammengefasst:<\/p>\n<blockquote><p>Aus diesem Grund verfolgt das Schmerzensgeld eine doppelte Zielsetzung, n\u00e4mlich erstens die Ausgleichsfunktion und zweitens die Genugtuungsfunktion.<\/p><\/blockquote>\n<p>Ist das die ganze Wahrheit?<\/p>\n<p><!--more--><br \/>\n<a href=\"http:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/04\/BunteBlumen.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-1030\" src=\"http:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/04\/BunteBlumen-206x300.jpg\" alt=\"BunteBlumen\" width=\"261\" height=\"379\" srcset=\"https:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/04\/BunteBlumen-206x300.jpg 206w, https:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/04\/BunteBlumen.jpg 659w\" sizes=\"auto, (max-width: 261px) 100vw, 261px\" \/><\/a>Wer die Frage &#8222;Welchen Funktionen dient das Schmerzensgeld&#8220; in einer m\u00fcndlichen Pr\u00fcfung beantworten soll, k\u00f6nnte die Antwort noch \u00fcber die vorgeschlagene Muster-L\u00f6sung von P\u00f6tters\/Werkmeister hinaus erg\u00e4nzen:<\/p>\n<p>Das Schmerzensgeld hat in Bezug auf Pers\u00f6nlichkeitsverletzungen n\u00e4mlich zus\u00e4tzlich eine Pr\u00e4ventivfunktion.<\/p>\n<p>Im Ergebnis kann man sich die Funktionen des Schmerzensgeldes also wie folgt merken:<\/p>\n<p>&#8211; Ausgleichsfunktion<\/p>\n<p>&#8211;\u00a0Genugtuungs- und S\u00fchnefunktion<\/p>\n<p>&#8211;\u00a0Pr\u00e4ventivfunktion (beim Pers\u00f6nlichkeitsrecht)<\/p>\n<p>(Wandt, Gesetzliche\u00a0Schuldverh\u00e4ltnisse, 2014, \u00a7 23 Rn. 44)<\/p>\n<p>Zwar ist die Pr\u00e4ventivfunktion des Schmerzensgeldes beim Pers\u00f6nlichkeitsrecht nicht unumstritten, wie wir bei Ludyga, ZEV 2014, 333 (337) lesen k\u00f6nnen:<\/p>\n<blockquote><p>Bedenken gegen die Pr\u00e4ventivfunktion werden vorgebracht, da Elemente des Strafrechts in das Zivilrecht hineingetragen werden. Behauptet wird, das strafrechtliche Analogieverbot gem\u00e4\u00df Art. 103 Abs. 2 GG sei verletzt, da es keine gesetzliche Grundlage gebe.<\/p><\/blockquote>\n<p>Aber das entbindet uns in einer Pr\u00fcfung nicht davon, diesen Aspekt zumindest anzusprechen.<\/p>\n<p>Der BGH jedenfalls ist der Ansicht, dass das Schmerzensgeld bei Pers\u00f6nlichkeitsrechtsverletzungen auch der Pr\u00e4vention dient:<\/p>\n<blockquote><p>Au\u00dferdem soll der Rechtsbehelf der Pr\u00e4vention dienen [&#8230;].<\/p><\/blockquote>\n<p>(BGH, Urteil vom 15.11.1994, <a title=\"VI ZR 56\/94\" href=\"http:\/\/www.caselaw.de\/document?si=7e1e066e-55d8-49f4-9209-3d1275514540&amp;di=019c0e3f-6bbd-46cc-bd9c-33bab50b695c&amp;pg=0\" target=\"_blank\">VI ZR 56\/94<\/a>)<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Wandt, Gesetzliche\u00a0Schuldverh\u00e4ltnisse, 2014, \u00a7 23 Rn. 44: &#8211;
