Da der BGH auf die Anspruchsgrundlage \u00a7 823 II BGB nicht eingegangen ist, hat sie die Fallbearbeitung um diese Komponente erg\u00e4nzt. Dabei ist ihr allerdings eine kleine Ungenauigkeit unterlaufen, die wir in unseren Klausuren vermeiden sollten. Sie schreibt auf Seite 218:<\/p>\n<blockquote><p>Weiterhin steht K gegen B ein Anspruch auf Zahlung eines angemessenen Schmerzensgeldes aus \u00a7 115 Abs. 1 S. 1 Nr. 1 VVG i.V.m. \u00a7 823 Abs. 1, Abs. 2 BGB i.V.m. \u00a7\u00a7 1 ff. StVO i.V.m. \u00a7 253 Abs. 2 BGB zu.<\/p><\/blockquote>\n<p>Dieses Normzitat enth\u00e4lt ein Element, das Korrektoren wahrscheinlich als zu ungenau r\u00fcgen w\u00fcrden.<\/p>\n<p><!--more--><\/p>\n<p>Das Problem befindet sich in dem Normzitat &#8222;\u00a7\u00a7 1ff. StVO&#8220;. Diese\u00a0Bezugnahme\u00a0ist zu allgemein. Dass ein solch konkretes Normzitat gefordert ist, zeigen Musterl\u00f6sungen.<\/p>\n<p>Benner, Referendarklausurenkurs Zivilrecht, 2014, Rn. 257:<\/p>\n<blockquote><p>&#8222;3. Wenn wir in einer\u00a0Klausur \u00a7 823 II BGB pr\u00fcfen wollen und Normen aus der StVO in Betracht kommen, so zitieren wir nicht \u00a7\u00a7 1ff StVO, sondern suchen die konkrete Norm, die in unserem Fall in Betracht kommt. Idealerweise bl\u00e4ttert man die StVO\u00a0zur Vorbereitung einmal durch, damit man im Ernstfall die passenden Normen\u00a0griffbereit hat.
