{"id":1664,"date":"2015-06-26T10:00:18","date_gmt":"2015-06-26T08:00:18","guid":{"rendered":"http:\/\/bloghosting.jurmatix.de\/klartext-jura\/?p=1664"},"modified":"2015-05-30T22:30:17","modified_gmt":"2015-05-30T20:30:17","slug":"artikel-oder-paragraph","status":"publish","type":"post","link":"https:\/\/bloghosting.jurmatix.de\/klartext-jura\/2015\/06\/26\/artikel-oder-paragraph\/","title":{"rendered":"Artikel oder Paragraph?"},"content":{"rendered":"<p>Heute soll von einem Problem die Rede sein, das sowohl in der schriftlichen wie auch\u00a0in der m\u00fcndlichen Pr\u00fcfung\u00a0eine Rolle spielen kann und psychologisch immer negativ zu Buche schl\u00e4gt, wenn man da einen Fehler macht. Betrachten wir zur Einf\u00fchrung folgenden Screen:<\/p>\n<p><a href=\"http:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/05\/emrk.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-1665\" src=\"http:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/05\/emrk.jpg\" alt=\"emrk\" width=\"899\" height=\"366\" srcset=\"https:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/05\/emrk.jpg 899w, https:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/05\/emrk-300x122.jpg 300w\" sizes=\"auto, (max-width: 899px) 100vw, 899px\" \/><\/a><\/p>\n<p>Was f\u00e4llt bei der Betrachtung auf?<\/p>\n<p><!--more--><\/p>\n<p>In die Zeile, in die man die zu suchende Norm eingibt, habe ich &#8222;19 emrk&#8220; eingetippt. In der Vorschlagszeile meint dejure.org dann, dass ich auf der Suche nach &#8222;\u00a7 19 EMRK&#8220; sei. Auf der Ergebnisseite hingegen ist (richtigerweise) von &#8222;Artikel 19&#8220; die Rede. Einpr\u00e4gen sollte man sich, dass die EMRK in Artikel eingeteilt ist und die falsche Vorschlagszeile bei dejure.org vergessen.<\/p>\n<p>Generell ist zu empfehlen, bei Normzitaten in Klausuren immer genau pr\u00fcfen, ob es sich um einen Artikel (wie zum Beispiel im Grundgesetz oder in der EMRK) oder um einen Paragraphen (wie zum Beispiel im BGB oder im StGB) handelt. Pr\u00fcfer sind allergisch, wenn man das verwechselt.<\/p>\n<p>Besondere Vorsicht ist dann angesagt, wenn es sich um ein Gesetz handelt, mit dem man weniger vertraut ist, zum Beispiel weil es aus einem anderen Bundesland stammt. Da kann es n\u00e4mlich Divergenzen in Sachen &#8222;Artikel versus Paragraph&#8220; geben:<\/p>\n<p>&#8211; Das saarl\u00e4ndische Verwaltungsverfahrensgesetz (SVwVfG) hat Paragraphen.<\/p>\n<p>&#8211; Das bayerische Verwaltungsverfahrensgesetz (BayVwVfG) hat Artikel.<\/p>\n<p>Nicht verwechseln sollte man \u00fcbrigens dieses Thema mit der Frage der Artikelgesetze. Letztere \u00e4ndern in der Regel mehrere Gesetze, wobei jedem Gesetz ein Artikel vorbehalten ist. Sie werden manchmal auch &#8222;Omnibusgesetz&#8220; genannt. Das ist aber mehr ein praktischer Arbeitsbegriff als ein empfehlenswerter juristischer Fachbegriff. Als ein Beispiel f\u00fcr ein Artikelgesetz aus j\u00fcngster Zeit kann das &#8222;Gesetz zur \u00c4nderung des Bundesbeamtengesetzes und weiterer dienstrechtlicher Vorschriften&#8220; (BGBl I 2015, S. 250ff) angef\u00fchrt\u00a0werden.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Heute m\u00f6chte ich mich mit einer Kleinigkeit besch\u00e4ftigen, die gro\u00dfe Wirkung haben kann, wenn man sie nicht beachtet.
