Heute geht es mal wieder um eine „Jura im Alltag“ – Beobachtung. Ich habe vor ein paar Tagen bei Rossmann eingekauft. Am Ende meines Kassenzettels befand sich dann folgender Gutschein:<\/p>\n

Das klingt ja erst einmal ganz gut. Wenn ich weitere Artikel kaufe, dann erhalte ich „1x altapharma Brausetabletten (80g\/90g)“ gratis. Das wollte ich nat\u00fcrlich ausprobieren. Also: Zweiter Rossmann-Besuch zum Zwecke der empirischen Rechtsforschung. Die Auswahl an altapharma Brausetabletten ist riesig<\/a>. Es gibt Brausetabletten f\u00fcr 0,49 Euro, aber auch solche f\u00fcr 0,99 Euro, 1,49 Euro und 1,99 Euro. Welche Brausetabletten sind von dem Gutschein erfasst? Aus der Beschreibung auf dem Coupon ergibt sich, dass es entweder 80g oder 90g sein m\u00fcssen. Ausgeschlossen sind also beispielsweise die „altapharma Brausetabletten Magnesium + Calcium + D3“, denn diese haben ein Gewicht von 92g.<\/p>\n

Aber wie w\u00e4re es mit den „altapharma Brausetabletten Fols\u00e4ure + B3 + B12 + Jod<\/a>„? Sie kosten 0,99 Euro und wiegen 80g. Das m\u00fcsste also funktionieren. Weit gefehlt … Die Kassiererin teilte mir nach dankenswerten Recherchen mit, dass ich mit diesem Coupon nur Brausetabletten f\u00fcr 0,49 Euro erhalten k\u00f6nnte. Unterstellt einmal, das sei so: Darf man dann mit „1x altapharma Brausetabletten (80g\/90g) gratis“ werben?<\/p>\n

Hier hilft ein Blick ins UWG. Dort hei\u00dft es im Anhang zu \u00a7 3 Abs. 3 UWG:<\/p>\n

Unzul\u00e4ssige gesch\u00e4ftliche Handlungen im Sinne des \u00a7 3 Abs. 3 sind<\/p>\n

21. das Angebot einer Ware oder Dienstleistung als „gratis“, „umsonst“, „kostenfrei“ oder dergleichen, wenn hierf\u00fcr gleichwohl Kosten zu tragen sind; dies gilt nicht f\u00fcr Kosten, die im Zusammenhang mit dem Eingehen auf das Waren- oder Dienstleistungsangebot oder f\u00fcr die Abholung oder Lieferung der Ware oder die Inanspruchnahme der Dienstleistung unvermeidbar sind;<\/p><\/blockquote>\n

Rossmann bietet auf dem Coupon „1x altapharma Brausetabletten (80g\/90g)“ gratis an. Damit fehlt es an einem Ausschluss, der die „altapharma Brausetabletten Fols\u00e4ure + B3 + B12 + Jod“ ausnehmen w\u00fcrde. Also werden „altapharma Brausetabletten Fols\u00e4ure + B3 + B12 + Jod“ als scheinbar gratis angeboten, obwohl daf\u00fcr Kosten zu tragen sind – der Coupon wird f\u00fcr dieses Produkt n\u00e4mlich nicht akzeptiert. Jetzt frage ich mal bei Rossmann, wie die das sehen :-). Vielleicht antworten sie ja: „Minima non curat praetor“.<\/p>\n
