Sollen wir jetzt die „Vorteilsbekanntmachung“ als terminus technicus unserem juristischen Wortschatz einverleiben?
\n<\/p>\n
Zun\u00e4chst zur Rekapitulation: Dadurch, dass die \u00dcberschrift in eckige Klammern gesetzt ist, wird deutlich gemacht, dass es sich nicht um eine amtliche, sondern um eine redaktionelle \u00dcberschrift handelt. Daraus l\u00e4sst sich f\u00fcr die Klausur-Praxis ableiten, dass man mit solchen redaktionellen \u00dcberschriften nicht argumentieren sollte.<\/p>\n
Nun aber zur Sache: Gibt es eine „Vorteilsbekanntmachung“? Nein! Gemeint ist die „Urteilsbekanntmachung“, die unter den genannten Voraussetzungen f\u00fcr die\u00a0obsiegende Partei m\u00f6glich ist. Entsprechende Regelungen gibt es auch in anderen Gesetzen, wie z.B.:<\/p>\n

Die jetzigen Fassungen dieser Vorschriften beruhen auf dem\u00a0Gesetz\u00a0zur Verbesserung der Durchsetzung von Rechten des geistigen Eigentums vom\u00a07. Juli 2008 (BGBl I, 2008, 1191 ff), das seinerseits der Umsetzung der Richtlinie 2004\/48\/EG des\u00a0Europ\u00e4ischen Parlaments und des Rates vom 29. April 2004 zur\u00a0Durchsetzung der Rechte des geistigen Eigentums (ABl. EU Nr. L 195,\u00a0S. 16) – Enforcement-Richtlinie – diente.<\/p>\n
Wie aus der Liste ersichtlich ist, gibt es die Bezeichnung „Urteilsbekanntmachung“ auch als amtliche \u00dcberschrift.<\/p>\n
\u00dcbrigens: In der Online-Datenbank von Beck ist bez\u00fcglich \u00a7 140e PatG \u00fcberschriftsm\u00e4\u00dfig alles in Ordnung:<\/p>\n

1 Ist eine Klage auf Grund dieses Gesetzes erhoben worden, so kann der obsiegenden Partei im Urteil die Befugnis zugesprochen werden, das Urteil auf Kosten der unterliegenden Partei \u00f6ffentlich bekannt zu machen, wenn sie ein berechtigtes Interesse darlegt. 2 Art und Umfang der Bekanntmachung werden im Urteil bestimmt. 3 Die Befugnis erlischt, wenn von ihr nicht innerhalb von drei Monaten nach Eintritt der Rechtskraft des Urteils Gebrauch gemacht wird. 4 Der Ausspruch nach Satz 1 ist nicht vorl\u00e4ufig vollstreckbar.
