Ich habe in den f\u00fcr die Pr\u00fcfung zugelassenen Sartorius in Art. 252 AEUV nachgeschaut. Dort steht in Absatz 1:<\/p>\n<blockquote><p>Der Gerichtshof wird von acht Generalanw\u00e4lten unterst\u00fctzt. Auf Antrag des Gerichtshofs kann der Rat einstimmig die Zahl der Generalanw\u00e4lte erh\u00f6hen.<\/p><\/blockquote>\n<p>Also ging ich &#8211; wie auch Kaiser\/Horst\/Horst, Pr\u00fcfungswissen Jura f\u00fcr die m\u00fcndliche Pr\u00fcfung, 2014, S. 27 &#8211; davon aus, dass am EuGH acht Generalanw\u00e4lte t\u00e4tig sind.<\/p>\n<p><!--more--><\/p>\n<p>Jedoch wurde von der Erm\u00e4chtigung in Satz 2 des Art. 252 AEUV Gebrauch gemacht. Juli 2013 waren also neun Generalanw\u00e4lte beim EuGH t\u00e4tig. Mit Wirkung zum 07. Oktober 2015 werden elf Generalanw\u00e4lte beim EuGH arbeiten.<\/p>\n<p>Sch\u00f6n w\u00e4re nat\u00fcrlich auch eine Fu\u00dfnote im Sartorius.&nbsp;Kaiser\/Bannach sprechen in der 2. Auflage 2015 von &#8222;Pr\u00fcfungswissen Jura f\u00fcr die m\u00fcndliche Pr\u00fcfung&#8220; jetzt auch von neun Generalanw\u00e4lten (S. 27).<\/p>\n<blockquote><p>Unterst\u00fctzt werden die Richter von neun Generalanw\u00e4lten.<\/p><\/blockquote>\n<p>Leider fehlt aber immer noch die Information, dass es mit Wirkung vom 7. Oktober 2015 elf Generalanw\u00e4lte geben wird. Auch wenn das Buch erst Anfang 2015 erschienen ist, datiert das Vorwort vom August 2014. Jedoch ist der Beschluss des Rates zur Erh\u00f6hung der Zahl der Generalanw\u00e4lte des Gerichtshofs der Europ\u00e4ischen Union bereits am 25.06.2013 ergangen, sodass die Information den Autoren bereits vorgelegen haben sollte.<\/p>\n<p><span style=\"text-decoration: underline\"><a href=\"http:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/06\/Pilger.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-1332\" src=\"http:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/06\/Pilger-212x300.jpg\" alt=\"Pilger\" width=\"212\" height=\"300\" srcset=\"https:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/06\/Pilger-212x300.jpg 212w, https:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/06\/Pilger.jpg 675w\" sizes=\"auto, (max-width: 212px) 100vw, 212px\" \/><\/a>Wir merken uns:<\/span><\/p>\n<p>Nach Art. 252 I 1 AEUV wird der EuGH von acht Generalanw\u00e4lten unterst\u00fctzt. Jedoch hat der Rat auf Antrag des Gerichtshofs die Zahl der Generalanw\u00e4lte erh\u00f6ht (Art. 252 I 2 AEUV):<\/p>\n<p>&#8211; Seit dem 01.07.2013 sind neun Generalanw\u00e4lte beim EuGH t\u00e4tig.<\/p>\n<p>&#8211; Ab dem 07.10.2015 wird der EuGH durch elf Generalanw\u00e4lte unterst\u00fctzt.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Fu\u00dfnote im Sartorius falsch im Buch zur m\u00fcndlichen Pr\u00fcfung?
