Werfen hier heute mal einen Blick auf eine Fall-L\u00f6sung von Burkhard Hess und Moritz Hennemann, die in der JuS 2010, 987 ff. abgedruckt ist. Dort hei\u00dft es auf Seite 989:<\/p>\n

II. Begr\u00fcndetheit der Erinnerung<\/p>\n

Begr\u00fcndet ist die Erinnerung, wenn die betreffende Zwangsvollstreckungsma\u00dfnahme unzul\u00e4ssig ist.<\/p>\n

1. Allgemeine Voraussetzungen der Zwangsvollstreckung, \u00a7 750 ZPO<\/p>\n

a) Titel<\/p>\n

Weitere Vollstreckungsvoraussetzungen sind nicht ersichtlich: Sicherheit war nicht zu leisten, \u00a7\u00a7 708 Nr. 2, 751 II, besondere Fristen waren nicht einzuhalten.<\/p>\n

e) Zwischenergebnis<\/p>\n

Mithin lagen die allgemeinen Voraussetzungen der Zwangsvollstreckung vor.<\/p><\/blockquote>\n

Es gibt hier einen weiteren Pr\u00fcfungspunkt, den man ansprechen k\u00f6nnte. Wahrscheinlich haben die Autoren ihn f\u00fcr zu selbstverst\u00e4ndlich gehalten. Trotzdem sollte er der Vollst\u00e4ndigkeit halber genannt werden. Um was k\u00f6nnte es sich handeln?<\/p>\n

<\/p>\n

\"\"<\/a>Genau, den Antrag. Der Gerichtsvollzieher, der im vorliegenden Fall die Vollstreckung durchgef\u00fchrt hat, wird n\u00e4mlich nach \u00a7 753 ZPO „im Auftrag des Gl\u00e4ubigers“ t\u00e4tig und nicht „automatisch“. Schlie\u00dflich muss nicht jeder Gl\u00e4ubiger, der einen Titel hat, der zugestellt und mit einer Klausel versehen wurde, auch eine Vollstreckungsma\u00dfnahme einleiten.<\/p>\n

Dementsprechend lesen wir bei Kliebisch in der JuS 2013, 316, 320:<\/p>\n

Als allgemeine Voraussetzung der Zwangsvollstreckung sind Titel (\u00a7\u00a7 750, 704, 794), Klausel (\u00a7 725) und Zustellung (\u00a7 750) zu ber\u00fccksichtigen. Als besondere Voraussetzung ist an den Antrag (\u00a7\u00a7 753, 754), das Verbot der \u00dcberpf\u00e4ndung (\u00a7 803) und die Voraussetzungen der Zug um Zug Vollstreckung (\u00a7\u00a7 751, 756, 765) zu denken.<\/p><\/blockquote>\n

Wir k\u00f6nnen uns merken: Der h\u00e4ufig zu lesende Dreiklang „Titel – Klausel – Zustellung“ ist unvollst\u00e4ndig. Es kommt stets auch auf die Frage an, ob ein Antrag des Gl\u00e4ubigers vorliegt.<\/p>\n","protected":false},"excerpt":{"rendered":"
