\"Katze<\/a>In der September-Ausgabe der JA 2014 (S. 710ff) titelt Heintschel-Heinegg: „Die ‚ungleichartige‘ Wahlfeststellung ist verfassungswidrig“.<\/p>\n

F\u00fcr Studenten ist die Besprechung des Anfragebeschlusses des 2. Strafsenats vom 28.01.2014 – 2 StR 495\/12<\/a> in der JA problematisch.<\/p>\n

Die \u00dcberschrift ist, ber\u00fccksichtigt man, dass es sich um einen Anfragebeschluss handelt, provokativ gew\u00e4hlt. Als Studentin muss ich gestehen, dass ich nicht immer alle Aufs\u00e4tze in der Ausbildungsliteratur vollst\u00e4ndig lesen kann. H\u00e4tte ich mir nur die \u00dcberschrift gemerkt, so h\u00e4tte ich die umstrittene Frage f\u00fcr eindeutiger entschieden gehalten, als sie ist.<\/p>\n

Aber wie ist die Lage denn nun tats\u00e4chlich?<\/p>\n

<\/p>\n

Ich habe die Besprechung von Heintschel-Heinegg inzwischen gelesen und zitiere, S. 712:<\/p>\n

Der Anfragebeschluss ist \u00fcberzeugend begr\u00fcndet und zu vermuten ist, dass die \u00fcbrigen vier Strafsenate des BGH sich dem anschlie\u00dfen.<\/p><\/blockquote>\n

Diese Vermutung hat sich (leider) nicht bewahrheitet. Der Stand der Dinge ist zum Erscheinen der JA Anfang September ein anderer.<\/p>\n

Im Beschluss des BGH vom 16. Juli 2014 \u2013 5 ARs 39\/14<\/a>\u00a0lautet der Tenor:<\/p>\n

Auf den Anfragebeschluss des 2. Strafsenats vom 28. Januar 2014 \u2013 2 StR 495\/12 \u2013 erkl\u00e4rt der Senat, dass er an seiner Rechtsprechung zur ungleichartigen Wahlfeststellung festh\u00e4lt.<\/p><\/blockquote>\n

Nun ist es allgemein bekannt, dass Urteile nicht immer sofort im Langtext verf\u00fcgbar sind. M\u00f6glicherweise h\u00e4tte also in der Septemberausgabe der JA noch kein Hinweis auf die aktuelle Entwicklung erfolgen k\u00f6nnen. Aber auch in der Oktober- und November-Ausgabe der JA habe ich keinen Hinweis zu der Antwort auf den Anfragebeschluss finden k\u00f6nnen. Als Leser juristischer Ausbildungsliteratur w\u00fcrde man sich freuen, wenn insofern der Service etwas verbessert w\u00fcrde. Keiner wei\u00df besser als die Autoren der Ausbildungsliteratur, wie wichtig es ist, dass Jura-Studenten immer auf dem aktuellen Stand sind, insbesondere was die Rechtsprechung angeht.<\/p>\n

Umso erstaunlicher ist es, dass auch in der R\u00dc 10\/2014 von Winkler auf Seite 641 auf den „aktuellen Anfragebeschluss des BGH v. 28.01.2014 – 2 StR 495\/12, R\u00dc 2014, 507ff“ verwiesen wird, ohne dem Leser zu verraten, dass schon eine Antwort auf den Anfragebeschluss vorliegt.<\/p>\n","protected":false},"excerpt":{"rendered":"
