Aufl. 2014 schreiben in \u00a7 23 Rn. 86:<\/p>\n<blockquote><p>Eine Reservierungsvereinbarung durch Individualvereinbarung sollte zugelassen werden. Anderer Ansicht zufolge ist die Reservierungsvereinbarung per se bereits, da ohne Wert, sittenwidrig und damit nichtig. Der Rechtsprechung zufolge ist die Vereinbarung nur sittenwidrig, wenn sie auf unbestimmte Dauer abgeschlossen wird oder der Kunde nur zur Zahlung eines unangemessen niedrigen Kaufpreis bereit ist und dies den Parteien der Reservierungsvereinbarung bewusst war.<\/p>\n<p>[&#8230;]<\/p>\n<p>Eine L\u00f6sung des Maklers von der Reservierungspflicht m\u00fcsste \u00fcber \u00a7 323 BGB (Fristsetzung mit Ablehnungsandrohung) erfolgen.<\/p><\/blockquote>\n<p>Fristsetzung mit Ablehnungsandrohung? Geh\u00f6rt habe ich die Formel schon, aber nur im Gespr\u00e4ch mit einem \u00e4lteren Juristen. Das spricht nicht unbedingt gegen die Formel, l\u00e4dt aber zu einer n\u00e4heren Betrachtung ein.<\/p>\n<p><!--more--><\/p>\n<p>Gibt es die Frisetzung mit Ablehnungsandrohung im R\u00fccktrittsrecht noch? Dazu schreibt Reiner Schulze:<\/p>\n<blockquote><p>Das R\u00fccktrittsrecht setzt iU zu \u00a7\u2009326&nbsp;aF weder eine Ablehnungsandrohung noch ein Vertretenm\u00fcssen des Schuldners voraus. Ein Grund f\u00fcr diese Neuerung ist, dass die alte Rechtslage f\u00fcr den rechtsunkundigen Gl\u00e4ubiger eine \u00dcberforderung darstellte; insb konnten die hohen Anforderungen, die die Rspr an die Ablehnungsanforderung stellte, idR nur von einer rechtskundig beratenen Partei wahrgenommen werden.
