Soweit der Hauptantrag, der Hilfsantrag oder ein unter mehreren vorrangiger Hilfsantrag erfolglos bleibt, muss die Klage selbstverst\u00e4ndlich „im \u00dcbrigen“ abgewiesen werden. Wer diese Wendung, was h\u00e4ufig geschieht, im Tenor vergisst, begeht einen Fehler.<\/p><\/blockquote>\n

Hier kann man einen Fehler machen? Ein solcher Hinweis in Lehrb\u00fcchern erh\u00f6ht nat\u00fcrlich immer die Aufmerksamkeit der Leserinnen und Leser.<\/p>\n

Mir scheint die Formulierung von Anders\/Gehle jedoch zu kurz gegriffen. Vielmehr meine ich, dass die verschiedenen Kombinationsm\u00f6glichkeiten von Haupt- und Hilfsantrag betrachtet werden m\u00fcssen, um feststellen zu k\u00f6nnen, ob die Notwendigkeit besteht, die Klage „im \u00dcbrigen“ abzuweisen.<\/p>\n

<\/p>\n

Zur Tenorkonstellationen bei objektiver Klageh\u00e4ufung sei grunds\u00e4tzlich die von G\u00f6tz Knoop<\/a> erstellte \u00dcbersicht beim Juristischen Internetprojekt Saarbr\u00fccken<\/a> empfohlen. Anhand der dortigen Beispiele kann man \u00fcberpr\u00fcfen, ob man die verschiedenen Tenorkonstellationen verstanden hat. Aber was hei\u00dft das jetzt konkret f\u00fcr die vorliegende Fragestellung?<\/p>\n

Die zitierte Feststellung von Anders\/Gehle enth\u00e4lt u.a. die Behauptung, dass – soweit der Hauptantrag erfolglos bleibt – die Klage selbstverst\u00e4ndlich „im \u00dcbrigen“ abgewiesen werden m\u00fcsse. Von dieser Formulierung werden jedoch zwei Konstellationen erfasst:<\/p>\n

Konstellation 1: Hauptantrag erfolglos, Hilfsantrag erfolgreich<\/p>\n

Konstellation 2: Hauptantrag erfolglos, Hilfsantrag erfolglos<\/p>\n

In der ersten Konstellation hat eine Klageabweisung im \u00dcbrigen zu erfolgen, wie Anders\/Gehle dies schreiben. In der zweiten Konstellation hingegen ist die Klage insgesamt abzuweisen (ohne den Zusatz „im \u00dcbrigen“).<\/p>\n

Betrachten wir noch eine weitere Variante, die dem Zitat von Anders\/Gehle entnommen werden kann. Wenn der Hilfsantrag erfolglos bleibt, solle die Klage selbstverst\u00e4ndlich „im \u00dcbrigen“ abgewiesen werden. Gehen wir von dem „Normalfall“ der echten eventuellen Klageh\u00e4ufung aus. Der Hilfsantrag ist also f\u00fcr den Fall gestellt, dass der Hauptantrag erfolglos bleibt. Damit sind in dem hier von Anders\/Gehle angenommenen Fall Hauptantrag und Hilfsantrag erfolglos. Wiederum ist kein Raum f\u00fcr eine Klageabweisung im \u00dcbrigen. Vielmehr ist die Klage insgesamt abzuweisen.<\/p>\n","protected":false},"excerpt":{"rendered":"
