{"id":4399,"date":"2018-09-24T10:00:04","date_gmt":"2018-09-24T08:00:04","guid":{"rendered":"http:\/\/bloghosting.jurmatix.de\/klartext-jura\/?p=4399"},"modified":"2018-09-23T17:16:20","modified_gmt":"2018-09-23T15:16:20","slug":"nimmt-jetzt-die-polizei-blut-ab","status":"publish","type":"post","link":"https:\/\/bloghosting.jurmatix.de\/klartext-jura\/2018\/09\/24\/nimmt-jetzt-die-polizei-blut-ab\/","title":{"rendered":"Nimmt jetzt die Polizei Blut ab?"},"content":{"rendered":"<p>In den letzten&nbsp;Tagen wurde&nbsp;in vielen Medien \u00fcber Bettina Wulff berichtet, zum Beispiel in der Bild-Zeitung wie <a href=\"https:\/\/www.bild.de\/politik\/inland\/politik-inland\/bettina-wulff-alkohol-fahrt-mit-mehr-als-2-promille-57391830.bild.html\">folgt<\/a>:<\/p>\n<p><a href=\"http:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2018\/09\/Polizei-nahm-ihr-Blut-ab.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-4400\" src=\"http:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2018\/09\/Polizei-nahm-ihr-Blut-ab.jpg\" alt=\"\" width=\"750\" height=\"426\" srcset=\"https:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2018\/09\/Polizei-nahm-ihr-Blut-ab.jpg 750w, https:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2018\/09\/Polizei-nahm-ihr-Blut-ab-300x170.jpg 300w\" sizes=\"auto, (max-width: 750px) 100vw, 750px\" \/><\/a><\/p>\n<p>Das f\u00fchrt nun &#8211; nimmt man die Bild-Zeitung w\u00f6rtlich &#8211; zu der Frage, ob die Polizei Frau Wulff Blut abgenommen hat.<\/p>\n<p><!--more--><\/p>\n<p>Zuerst ein kurzer Blick auf die Rechtslage. Einschl\u00e4gig ist \u00a7 81a StPO:<\/p>\n<blockquote><p>(1) Eine k\u00f6rperliche Untersuchung des Beschuldigten darf zur Feststellung von Tatsachen angeordnet werden, die f\u00fcr das Verfahren von Bedeutung sind. Zu diesem Zweck sind Entnahmen von Blutproben und andere k\u00f6rperliche Eingriffe, die von einem Arzt nach den Regeln der \u00e4rztlichen Kunst zu Untersuchungszwecken vorgenommen werden, ohne Einwilligung des Beschuldigten zul\u00e4ssig, wenn kein Nachteil f\u00fcr seine Gesundheit zu bef\u00fcrchten ist.<\/p>\n<p>(2) Die Anordnung steht dem Richter, bei Gef\u00e4hrdung des Untersuchungserfolges durch Verz\u00f6gerung auch der Staatsanwaltschaft und ihren Ermittlungspersonen (\u00a7 152 des Gerichtsverfassungsgesetzes) zu. Die Entnahme einer Blutprobe bedarf abweichend von Satz 1 keiner richterlichen Anordnung, wenn bestimmte Tatsachen den Verdacht begr\u00fcnden, dass eine Straftat nach \u00a7 315a Absatz 1 Nummer 1, Absatz 2 und 3, \u00a7 315c Absatz 1 Nummer 1 Buchstabe a, Absatz 2 und 3 oder \u00a7 316 des Strafgesetzbuchs begangen worden ist.<\/p>\n<p>[&#8230;]<\/p><\/blockquote>\n<p>Wenn also einer der in \u00a7 81a Abs. 2 StPO genannten F\u00e4lle vorliegt, kann es zur Entnahme einer Blutprobe ohne richterliche Anordnung kommen. Allerdings darf diese Blutprobe &#8211; wie aus \u00a7 81a Abs. 1 StPO hervorgeht &#8211; nur von einem Arzt nach den Regeln der \u00e4rztlichen Kunst durchgef\u00fchrt werden. Also nicht, wie dies die Formulierung in der Bild-Zeitung nahelegt, von der Polizei.<\/p>\n<p>Aber Achtung: Daraus folgt nur, dass die Polizei Frau Wulff kein Blut abnehmen durfte (!). Das ist eine normative Frage. Was die Polizei tats\u00e4chlich getan hat, folgt aus der Norm nicht.
