Anders gefragt: Kann eine Klausel bereits bei erstmaliger Verwendung als Allgemeine Gesch\u00e4ftsbedingung qualifiziert werden?<\/p>\n\n\n\n\n\n\n\n
Ausgangspunkt der Betrachtung ist \u00a7 305 Abs. 1 Satz 1 BGB:<\/p>\n\n\n\n
\nAllgemeine Gesch\u00e4ftsbedingungen sind alle f\u00fcr eine Vielzahl von Vertr\u00e4gen vorformulierten Vertragsbedingungen, die eine Vertragspartei (Verwender) der anderen Vertragspartei bei Abschluss eines Vertrags stellt.<\/p>\n<\/blockquote>\n\n\n\n
Das Merkmal „Vielzahl von Vertr\u00e4gen“ wird mit einer dreimaligen Verwendung definiert. Allerdings ist zur Realisierung dieser tatbestandlichen Voraussetzung nicht erforderlich, dass die Haftungsausschluss-Klausur tats\u00e4chlich dreimal verwendet wird. Ausreichend ist eine entsprechende Absicht. Mit den Worten des BGH:<\/p>\n\n\n\n
