Dazu hei\u00dft es auf Seite 301:<\/p>\n<blockquote><p>Als weiterer \u201eRettungsanker\u201c kommt der sog. Blue-pencil-Test in Betracht.<\/p><\/blockquote>\n<p>Danach beschreiben die Autoren, was rechtlich unter diesem Blue-pencil-Test zu verstehen ist:<\/p>\n<blockquote><p>Hier wird gepr\u00fcft, ob sich die Regelungen sowohl sprachlich als auch inhaltlich trennen lassen und der unwirksame Teil der Klausel derart aus dieser gestrichen werden kann, dass der verbleibende Teil f\u00fcr sich genommen sinnvoll und sprachlich verst\u00e4ndlich ist.<\/p><\/blockquote>\n<p>Dann wird beschrieben, in welchen F\u00e4llen der Blue-pencil Test m\u00f6glich\/unm\u00f6glich ist:<\/p>\n<blockquote><p>Dies kommt h\u00e4ufig bei zweistufigen Ausschlussfristen in Betracht, da diese naturgem\u00e4\u00df teilbar sind. Im \u00dcbrigen bleibt auch dieser Ausweg zumeist verschlossen, da in der Praxis selten auf eine sprachliche Trennbarkeit der verschiedenen Regelungen geachtet wird und hierzu nicht selten regelrechte Formulierungsk\u00fcnste erforderlich w\u00e4ren.<\/p><\/blockquote>\n<p><!--more--><br \/>\n<a href=\"http:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/05\/BlaueBlume.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-1318 size-medium\" src=\"http:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/05\/BlaueBlume-225x300.jpg\" alt=\"BlaueBlume\" width=\"225\" height=\"300\" srcset=\"https:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/05\/BlaueBlume-225x300.jpg 225w, https:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/05\/BlaueBlume.jpg 720w\" sizes=\"auto, (max-width: 225px) 100vw, 225px\" \/><\/a><\/p>\n<p>Auch wenn man mit dem Blue-pencil-Test so rechtlich in einer Pr\u00fcfung umgehen kann, &#8222;droht&#8220; zumindest in der m\u00fcndlichen Pr\u00fcfung eine Folgefrage: Warum hei\u00dft der &#8222;Blue-pencil Test&#8220; so und nicht anders?<\/p>\n<p>Damit man durch diese Frage nicht &#8222;auf dem falschem Fu\u00df&#8220; erwischt wird, hier die Antwort:<\/p>\n<p>Fr\u00fcher wurden Manuskripte vom Lektor mit einem blauen Farbstift korrigiert.
