{"id":882,"date":"2016-02-08T10:00:01","date_gmt":"2016-02-08T09:00:01","guid":{"rendered":"http:\/\/bloghosting.jurmatix.de\/klartext-jura\/?p=882"},"modified":"2015-09-22T21:35:15","modified_gmt":"2015-09-22T19:35:15","slug":"%c2%a7-316a-stgb-%c2%a7-248b-stgb","status":"publish","type":"post","link":"https:\/\/bloghosting.jurmatix.de\/klartext-jura\/2016\/02\/08\/%c2%a7-316a-stgb-%c2%a7-248b-stgb\/","title":{"rendered":"\u00a7 316a StGB &#8211; \u00a7 248b StGB"},"content":{"rendered":"<p>In der JuS 2014, 1135ff bespricht\u00a0Matthias Jahn die Entscheidung des\u00a0<span class=\"gericht\">BGH<\/span><em class=\"italic_on\">,\u00a0<\/em><span class=\"etyp\">Beschluss vom\u00a0<\/span><span class=\"datum\">23.07.2014<i>,\u00a0<\/i><\/span><span class=\"az\"><a href=\"http:\/\/juris.bundesgerichtshof.de\/cgi-bin\/rechtsprechung\/document.py?Gericht=bgh&amp;Art=en&amp;nr=68799&amp;pos=0&amp;anz=1\" target=\"_blank\">2 StR 104\/14<\/a>. Bei der Lekt\u00fcre bin ich\u00a0<\/span>\u00fcber folgenden Satz gestolpert:<\/p>\n<blockquote><p>1. An ihn [\u00a7 316a StGB, M.H.] ist stets zu denken, wenn ein \u00dcberfall auf Insassen eines Kfz (zum Begriff: \u00a7 248b IV StGB) geschildert wird.<\/p><\/blockquote>\n<p>Aber in \u00a7 248b IV StGB steht doch &#8222;Kraftfahrzeuge im Sinne <span style=\"text-decoration: underline\">dieser<\/span> Vorschrift&#8220;?<\/p>\n<blockquote><p>\u00a7 248b StGB:\u00a0Unbefugter Gebrauch eines Fahrzeugs<\/p>\n<p>(4) Kraftfahrzeuge im Sinne dieser Vorschrift sind die Fahrzeuge, die durch Maschinenkraft bewegt werden, Landkraftfahrzeuge nur insoweit, als sie nicht an Bahngleise gebunden sind.<\/p><\/blockquote>\n<p>Gepr\u00fcft wird hier jedoch\u00a0\u00a7 316a StGB? Im Ausgangspunkt kann sich die Legaldefinition in \u00a7 248b IV StGB dem Wortlaut nach\u00a0nur auf den Anwendungsbereich von \u00a7 248b StGB beziehen.<\/p>\n<p><!--more--><\/p>\n<p>Jedoch ist es allgemein anerkannt, dass im Rahmen des \u00a7 316a StGB auch auf die Legaldefinition in \u00a7 248b IV StGB zur\u00fcckgegriffen werden darf.<\/p>\n<p>So hei\u00dft es beispielsweise im Urteil des\u00a0BGH\u00a0vom 24.06.1993, 4 StR 217\/93, NJW 1993, 2629:<\/p>\n<blockquote><p>Nach dem Wortlaut dieser Vorschrift k\u00f6nnen Opfer eines r\u00e4uberischen Angriffs F\u00fchrer von Kraftfahrzeugen oder deren Mitfahrer sein (\u00a7 316a I 1 StGB). Unter Kraftfahrzeugen sind nach den \u00a7\u00a7 248b IV StGB, 1 II StVG, 4 I 1 StVZO alle durch Maschinenkraft angetriebenen, nicht an Gleise gebundenen Landfahrzeuge zu verstehen.<\/p><\/blockquote>\n<p><a href=\"http:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/04\/Schmetterling-2015.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft  wp-image-910\" src=\"http:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/04\/Schmetterling-2015-228x300.jpg\" alt=\"Schmetterling-2015\" width=\"282\" height=\"371\" srcset=\"https:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/04\/Schmetterling-2015-228x300.jpg 228w, https:\/\/bloghosting.jurmatix.de\/klartext-jura\/files\/2015\/04\/Schmetterling-2015.jpg 594w\" sizes=\"auto, (max-width: 282px) 100vw, 282px\" \/><\/a>(So auch die Literatur unter Bezugnahme auf dieses Urteil, zum Beispiel Bosch, Jura 2013, 1234 (1240); Esser in Anwaltkommentar, StGB, 2015, \u00a7 316a StGB, Rn. 7 iVm Fn. 11; Rengier, Strafrecht BT I, 2014, \u00a7 12 Rn. 42).<\/p>\n<p>Das sollten wir uns merken, da man ohne diese Zusatzinformation aufgrund des Wortlauts wohl nicht auf die Idee gekommen w\u00e4re, \u00a0im Rahmen des \u00a7 316a StGB auf \u00a7 248b IV StGB zur\u00fcckzugreifen.<\/p>\n<p>Und: Man hat das Auswendiglernen einer Definition gespart :-).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In der JuS 2014, 1135ff bin ich \u00fcber folgenden Satz gestolpert: 1.
